What’s happened to your build?

Each situation changes what happens next. Choose the one closest to yours.
And we’ll take it from there.

My builder has gone broke, or into administration or liquidation

Work has stopped and the company can't pay its debts. An administrator or liquidator now controls it and decides what happens to your contract. Work rarely starts up again on its own, and your contract, deposit and home warranty insurance could all be affected.

My builder has passed away or can't be contacted

If your builder was a sole trader, the contract may not be able to continue. If calls go unanswered and no one is on site, home warranty insurance may apply in some situations. Either way, your site still needs to be secured and assessed.

My builder has abandoned the job

Your builder has walked off site or stopped work with no plan to come back.

Homes we've got over the line

These are real projects. In some cases, names and locations have been changed at the request of the homeowners.

We can pick up where your builder left off

Whatever stage your build stopped at, we’ll assess it first and tell you honestly whether we can complete it.

Build stages: Slab, Frame, Lock-Up, Fit-Off, Final and Defects

An administrator or liquidator takes control of the company and decides what happens to its contracts. Work usually doesn’t restart on its own. Secure your site if you can, gather your contract, payment records and photos, and get an independent view of where the build stands. If home warranty insurance applies, you’ll usually need to make a claim and act on it.

In NSW, HBCF generally applies when a builder can't complete the work because they've become insolvent, died, disappeared, or had their licence suspended in certain circumstances. It doesn't usually cover a dispute with a builder who is still trading. More detail: Cover limits, time limits and what's included depend on your policy and your situation. Check your certificate, then speak to icare directly. We don't manage insurance claims, but our site assessment gives you the building facts an insurer will ask for: what's been built, what's defective and what it will cost to complete.

Often, yes. Before we can start, your contract with the original builder needs to be properly ended, and we need to inspect the site. More detail: We'll look at the work already done, check for defects and confirm what's needed to complete it safely and to standard. Then we'll tell you honestly whether we're the right builder for your project, and if so, give you a clear quote to finish it. [Confirm which build stages Spiti Abode takes on.]

No. Spiti Abode Pty Ltd is a licensed NSW building company (Contractor Licence 491633C, ACN 631 873 740). More detail: Our role is to assess the construction situation and give you practical building advice. We don't give legal or financial advice, and we're not affiliated with icare, NSW Fair Trading or the NSW Government. If your situation needs a lawyer, we'll tell you, and we're happy to work alongside them.

A call with a licensed builder and, where it helps, a site visit and a plain-English summary of where your build stands. More detail: On the call we'll learn what's happened, where your build is up to and what you need. If a site visit makes sense, we'll inspect the work done so far and talk you through what we find. There's no cost and no obligation to use us. [Confirm exactly what is included free, and whether a written report is free or paid.]

Yes. We can give you an independent view of the build: progress against what you've paid, any defects, and what it will take to finish. More detail: Having the building facts helps you raise concerns with your builder clearly and in writing. If it becomes a formal dispute, NSW Fair Trading offers a free dispute resolution service for home building disputes, and a construction lawyer can advise on your contract rights. We can't take over while your contract is still in place.
